1. Definitions and Interpretation
"2GoBroadBand", "we", "us", "our" means 2GoBroadBand Pty Ltd. "Agreement" means these Terms together with any Service Order Form and Critical Information Summary. "Customer", "you", "your" means the individual or entity applying for Services. "Service" means any internet, broadband, mobile broadband, or telecommunications service. "Equipment" means any modem, router, or hardware sold by us.
2. Agreement and Acceptance
By applying for, activating, or using any Service, you agree to be bound by this Agreement in its entirety. This Agreement is governed by the laws of Victoria, Australia. We may update this Agreement from time to time with at least 30 days' written notice.
3. Services
2GoBroadBand provides Fixed Home Broadband, Mobile Broadband, Business/Enterprise Internet, and Developer & Estate Connectivity services. Service availability is subject to network coverage and infrastructure. We do not guarantee uninterrupted or fault-free access.
4. Contract Terms
Residential plans are month-to-month with no lock-in contract. Month-to-month customers may cancel at any time with 30 days' written notice. Fixed-term customers who cancel early may be charged an Early Termination Charge equal to remaining monthly fees less costs saved.
5. Billing and Payment
Services are billed monthly in advance. We accept credit/debit card and direct debit. If payment is not received by the due date, we may restrict or suspend your Service. All fees are inclusive of GST. A valid tax invoice accompanies each bill.
6. Equipment
Equipment purchased becomes your property upon full payment. You are responsible for its care and safekeeping. Risk passes on delivery. Equipment carries any applicable manufacturer's warranty.
7. Installation and Connection
Where installation is required, we or our contractors will arrange an appointment. Tenants must obtain landlord consent for physical alterations. We are not responsible for delays caused by nbn co or events outside our reasonable control.
8. Acceptable and Fair Use
You must use the Service only for lawful purposes. You must not send spam, infringe intellectual property, distribute malware, gain unauthorised access to systems, or resell the Service without consent. Unlimited plans are subject to our Fair Use Policy.
9. Suspension and Termination
We may suspend your Service immediately for non-payment, material breach, or to protect network integrity. We may terminate with 30 days' notice for any reason, or immediately for serious breach. On termination, all outstanding fees become immediately due.
10. Privacy and Data
We collect and use your personal information in accordance with our Privacy Policy, the Privacy Act 1988 (Cth), and the Australian Privacy Principles. By entering this Agreement, you consent to the collection and use of your personal information.
11. Liability
Our total aggregate liability is limited to the total amount you paid in the 3 months preceding the event. We are not liable for indirect or consequential loss. Nothing excludes rights under the Australian Consumer Law that cannot be excluded.
12–16. Changes, Faults, Complaints, Force Majeure & General
We may change features or pricing with 30 days' notice. Report faults via phone, email, or portal. Complaints are acknowledged within 2 business days. Unresolved complaints may be escalated to the TIO (www.tio.com.au · 1800 062 058). Neither party is liable for force majeure events. This Agreement is subject to the Telecommunications Act 1997 (Cth) and the TCP Code.
