1. Definitions and Interpretation
"2GoBroadBand", "we", "us", "our" means 2GoBroadBand Pty Ltd. "Agreement" means these Terms together with any Service Order Form and Critical Information Summary. "Customer", "you", "your" means the individual or entity applying for or receiving Services. "Service" means any internet, broadband, mobile broadband, or telecommunications service. "Equipment" means any modem, router, or hardware sold by us. "Billing Period" means the monthly period for which fees are charged.
2. Agreement and Acceptance
2.1 By applying for, activating, or using any Service, you agree to be bound by this Agreement in its entirety.
2.2 This Agreement is governed by the laws of Victoria, Australia.
2.4 We may update this Agreement from time to time with at least 30 days' written notice. Continued use of the Service constitutes acceptance.
3. Services
2GoBroadBand provides Fixed Home Broadband, Mobile Broadband, Business/Enterprise Internet, and Developer & Estate Connectivity services across Australia.
Service availability is subject to network coverage and infrastructure. We do not guarantee uninterrupted or fault-free access. Advertised speeds are maximum tier speeds; actual speeds vary.
4. Contract Terms and Minimum Term
Residential plans are month-to-month with no lock-in contract unless stated in your Service Order Form. Month-to-month customers may cancel at any time with 30 days' written notice without Early Termination Charges.
Fixed-term customers who cancel early may be charged an Early Termination Charge (ETC) equal to remaining monthly fees less costs saved by 2GoBroadBand.
5. Billing and Payment
Services are billed monthly in advance. Your first invoice may differ due to pro-rata charges. We accept credit/debit card (Visa, Mastercard) and direct debit.
If payment is not received by the due date, we may restrict or suspend your Service after issuing a reminder. Outstanding debt may be referred to a collections agency.
All fees are inclusive of GST unless otherwise stated. A valid tax invoice will accompany each bill.
6. Equipment
Equipment purchased becomes your property upon full payment. You are responsible for its care and safekeeping. Risk passes to you on delivery. Equipment carries any applicable manufacturer's warranty.
7. Installation and Connection
Where installation is required, we or our contractors will arrange an appointment. You must ensure safe access. Tenants must obtain landlord consent for physical alterations. We are not responsible for delays caused by nbn co or events outside our reasonable control.
8. Acceptable and Fair Use
You must use the Service only for lawful purposes. You must not use the Service to send spam, infringe intellectual property rights, distribute malware, gain unauthorised access to systems, resell the Service without our consent, or breach our wholesale agreements.
Unlimited plans are subject to our Fair Use Policy. Breach may result in restriction, suspension, or termination of your Service.
9. Suspension and Termination
We may suspend your Service immediately for non-payment, material breach, regulator direction, or to protect network integrity. We may terminate with 30 days' notice for any reason, or immediately for serious breach. On termination, all outstanding fees become immediately due.
10. Privacy and Data
We collect, hold, use, and disclose your personal information in accordance with our Privacy Policy, the Privacy Act 1988 (Cth), and the Australian Privacy Principles. By entering this Agreement, you consent to the collection and use of your personal information as described in our Privacy Policy at www.2gobroadband.com.au.
11. Liability
To the maximum extent permitted by law, our total aggregate liability is limited to the total amount you paid for the Service in the 3-month period preceding the event giving rise to the claim.
We are not liable for indirect, special, incidental, or consequential loss. Nothing excludes rights under the Australian Consumer Law that cannot be excluded by agreement.
12. Changes to Services and Pricing
We may change features, speeds, or pricing with at least 30 days' written notice. If you do not accept a material detrimental change, you may cancel within the notice period without incurring an ETC.
13. Faults and Customer Support
Report faults via phone, email, or our online portal. We will investigate and work to resolve faults within a reasonable timeframe. We are not responsible for faults caused by your Equipment, internal wiring, your actions, or events outside our control.
14. Complaints and Dispute Resolution
If you have a complaint, contact us first. We will acknowledge within 2 business days and aim to resolve within 15 business days. If unresolved, you may contact the Telecommunications Industry Ombudsman (TIO) at www.tio.com.au or 1800 062 058.
15. Force Majeure
Neither party will be liable for delays caused by circumstances beyond reasonable control, including natural disasters, government acts, fire, flood, pandemic, or third-party infrastructure failures.
16. General Provisions
This Agreement is the entire agreement between the parties. Invalid provisions do not affect the rest. This Agreement is subject to the Telecommunications Act 1997 (Cth), the TCP Code, and applicable ACMA standards.
